Terms of Service
By commissioning CaffeineHazard, you (referred to as "the client") state that you have read, understood, and agree to this TOS.✮ Commissions are worked on Sunday-Tuesday and Thursday-Friday AEST with Wednesday and Saturday as off or personal art days.
Completion time may be affected for reasons including but not limited to: Health concerns (such as illness or injuries to CaffeineHazard or their pets and family), unplanned life events (such as unplanned power or internet outages, dangerous weather conditions such as floods, tablet no longer working)

✮ Commissions with deadlines have priority. However, all deadlines must be stated up front, minimum 2 weeks in advance. For holiday season deadlines, please allow 4 weeks in advance.✮ Quotes are valid for up to 6months.✮ The client is paying CaffeineHazard for the skill and time spent making the commissioned artworks, not for the commercial copyright of the completed work(s)✮ Rush orders will incur a 50% fee on top of the commission quote.✮ Pricing in examples is a base price and may incur additional cost due to complexity of character design, number of characters, number of limbs, scene complexity, request of a rush piece, and alternate image versions. All increases in price will be stated up front in the commission quote. If add-ons are requested after payment or completion, additional costs may still incur.✮ The client must have a clear visual reference(s) at hand. At least one of the reference images MUST be flat coloured. If a flat colour reference is not able to be provided, please have the RGB codes or a screen shot of the exact colour swatch from Google for the correct shades. CaffeineHazard is unable to change and re-colour completed and approved commissions.✮ As it is easy to misinterpret what the client is asking for without a visual reference, please make sure to use as much detail as possible when describing your character or quickly doodle up a reference using a free template to better assist. Please have ALL information for your character ready before commissioning to prevent longer wait times for other clients.✮ Concept sketch will be sent for approval before any lining/coloring begins. If changes to pose, anatomy, etc. is desired, the client must request so during this stage. If changes are requested after the fully completed image, additional fees will incur.✮ Commission work will be uploaded to social media and may be used by CaffeineHazard as examples, showcase pieces or in price sheets, etc. Please state up front if this is not acceptable. If the client opts for the piece to not be uploaded, an additional 50% private commission fee may incur.Payment
✮ Payment is required upfront at the beginning of the commission.✮ Payment for international clients will be via Paypal or Ko-fi only. Australian clients have the option of bank transfer, PayID or Beem It.✮ CaffeineHazard will send the client an invoice once a final quote is agreed upon. Payment must be received within 48 hours unless stated otherwise.✮ Payment plans available for commissions greater than $100 USD.✮ Prices are non-negotiable.Cancellations and Refunds
✮ Either party may cancel the commission at any time, for any reason or lack thereof.✮ Cancellation by CaffeineHazard: Client receives full refund.✮ Cancellation by client: A full refund will only be given if the artwork has not been completed. If the piece is not started, a full refund will be given. However, if the piece has been lined, a partial refund will be offered.✮ No refunds or discounts will be given on completed works. Cancelled/Refunded artworks may be repurposed into YCH or personal artworks. All resemblance to the original subject/character will be changed.
Client reserves no rights to cancelled/refunded artwork.Client Rights and Responsibilities
✮ The client will receive signed and watermarked art for upload to social media with a smaller signature version for personal use, such as - printing the image onto a t-shirt or other personal uses. Commercial use is not permitted without written approval from CaffeineHazard.
The client may post the Watermarked version ONLY of the commissioned artwork to any site, with proper credit/attribution. (@CaffeineHazard on most social media. All contacts can be found in the contact section of this site) Removal of, or alteration to the signature or watermark or uploading the small signature version to social media is not permitted. Removal or alteration of signature/watermark will result in being placed on a blacklist.✮ The client may not feed any artwork by CaffeineHazard into AI. Please see Blockchain disclaimer for futher information.✮ The client may resize, crop or edit the artwork for personal, non-profit, non-commercial use ONLY, and with proper credit.✮ The client must be sure to save their completed commission. CaffeineHazard will not be responsible for any lost commissions and does not keep the .psd files after client approval.
The use of CaffeineHazard's artwork
✮ Any and all art made by CaffeineHazard (at any stage of completion) may not be put onto or used by any and all past, present and future blockchain-associated technologies, all past, present and future AI, NFT marketplaces, made into NFTs, or Cryptocurrencies under any and all circumstances at any time. This includes past, present and future derivatives, versions, evolutions of these prior mentioned technologies, selling platforms or trading/investing spaces; this includes public or private websites and/or mobile applications.
The commercial use of personal, individual use labeled commissioned artwork in any shape or form without the strict written permission by CaffeineHazard is prohibited. This includes actions performed by means such as a bot or human decision.
If it is discovered that a client uses any past, present or future commissioned artwork created by CaffeineHazard as an NFT or Crytpocurrency in any form whatsoever at any time, the client shall be:-Banned from using CaffeineHazard's services-Pay CaffeineHazard the entire amount earned from NFT and Cryptocurrency sales (using a regulated, government recognised currency; preferable in AUD or USD via PayPal or E-Transfer)-Have their commission removed from CaffeineHazard's public art hosting services.
